Our client, Amina Co., Ltd., is an Indian pharmacy company. On September, 2003, the company’s trademark “IBUCAP” designated to be used in Category No. 5 was maliciously registered. Then we raised an opposition application regarding such dispute, which failed due to the fact that our client did not have sufficient evidences in proving its priority of use. However, our firm found out that the registrant was trying to sell the IBUCAP trademark on internet in public. Also, we noticed that it is not possible for citizens to work on pharmaceutical production industry on their own, so we decided to use the strategy: to register on-one-side, to revoke on-another-side. Afterwards, we successfully revoked the trademark on grounds that it has not been used in three years. Moreover, we delayed the registration application procedure of our trademark. And finally, we successfully seized back such trademark for our foreign client through over 10 years’ hard works.
